TERMS AND CONDITIONS OF DRIVER TRAINING – JOE BASS APPROVED DRIVING INSTRUCTOR

By booking or attending driving lessons with Joe Bass, you agree to the Terms and Conditions set out below.

Joe Bass operates in accordance with the DVSA Approved Driving Instructor Code of Practice.

1. Driving Licence Requirements

You must hold a valid UK provisional driving licence and bring it to every lesson.

If you fail to produce a valid licence, the lesson will be terminated and the full lesson fee will be payable.

Joe reserves the right to refuse tuition or cancel lessons if a valid licence is not produced prior to the first lesson.

You agree that Joe may check your licence with the DVLA using a licence check code upon request.

2. Lessons & Contract

The contract for driving tuition is solely between you and Joe Bass.

You and Joe are responsible for agreeing:

  • Lesson dates and times
  • Lesson duration
  • Pick-up and drop-off locations

Lessons are normally two hours unless otherwise agreed.

3. Lesson Prices & Payment

Lesson prices are available on request and may change at any time.
All prices include VAT where applicable.

Lessons must be paid at least 48 hours in advance

Payment is accepted by bank transfer only.

If payment has not cleared at least 48 hours before the scheduled lesson, Joe may treat the lesson as cancelled and will not attend.

4. Advance Payments & Holding of Funds

Advance Payments

Customers may be asked to pay for lessons in advance. These payments are for lessons not yet delivered.

Where Your Money Is Held

All advance payments are held separately in a UK Zopa savings account until lessons are completed.
This account is used solely to hold customer funds and is separate from personal spending accounts.

Zopa Bank Limited is authorised and regulated by the Prudential Regulation Authority and the Financial Conduct Authority.
Eligible deposits are protected by the Financial Services Compensation Scheme (FSCS).

Use of Funds

Once a lesson has been completed, the relevant amount is transferred into Joe’s personal account as payment for services provided.

Records

Accurate digital records are kept of:

  • Payments made
  • Lessons completed
  • Remaining balances

Refunds

Refunds for unused lessons will be provided where required by law. In other circumstances, refunds may be offered at Joe’s discretion

Lessons already taken are non-refundable unless required by law.

Refunds will be made within a reasonable timeframe.

Interest

Any interest earned while funds are held is retained by the business and is not payable to customers.

Business Continuity

If Joe is unable to continue providing lessons, unused balances will be refunded as soon as reasonably practicable.

5. Pick-Up & Drop-Off Locations

Lessons may start and finish at different locations provided:

  • Both locations are within the usual working area
  • The arrangement is agreed at least one week in advance

6. Cancellations, Re-Arrangements & No-Shows

Cancellations

Lessons must be cancelled with at least 48 hours’ notice.

Lessons cancelled within 48 hours may be charged in full where the slot cannot reasonably be re-filled.

Repeated cancellations may result in charges being applied.

Re-Arranged Lessons

Lessons cancelled and re-booked within five days will not incur an additional charge.

No-Shows

Failure to attend a lesson without notice will result in the full lesson fee being charged.

7. Communication Policy

All communication must be directly between you and Joe (not via friends or relatives).

Joe may not respond immediately during teaching hours.
Messages will not be answered while driving or travelling between lessons. Road safety always takes priority.

8. Bad Weather

Lessons will go ahead as booked unless Joe advises otherwise.

If weather conditions make a lesson unsafe, Joe will contact you to rearrange.

9. Holidays & Availability

Joe will provide as much notice as possible of holidays or unavailable dates.
You are asked to do the same to maintain learning continuity.

To retain your diary slot, please ensure your next lesson is booked following any break in tuition.

10. Health, Safety & Fitness to Drive

You must:

  • Wear suitable clothing and practical footwear
  • Wear any required glasses or contact lenses

If you are taking medication that may affect your ability to drive, please inform Joe as early as possible.

Where Joe reasonably believes a pupil is unfit to drive due to drink, drugs, or impairment, the lesson will be terminated on safety grounds and the full lesson fee will be payable.

There is no smoking at any time during lessons.

11. Practical & Theory Tests

Practical tests must only be booked with Joe’s prior agreement.

Tests booked without agreement carry no assurance that Joe’s vehicle will be available.

You are responsible for booking your own theory and practical tests unless otherwise agreed.

Joe reserves the right to refuse use of his vehicle for a test where, in his professional opinion, the pupil is not test-ready or where safety, insurance, or vehicle availability concerns apply.

Mock tests will be offered and are strongly recommended.

12. Complaints

If you have a concern, please raise it with Joe first so it can be resolved.

If you believe the service does not meet business standards, you may contact Citizens Advice.

If you are unhappy with Joe’s professional conduct, you may contact the ADI Registrar:

13. What Your Tuition Includes

Joe will:

  • Provide one-to-one tuition at the agreed rate
  • Tailor lessons to your learning needs
  • Use a modern, dual-controlled vehicle
  • Monitor progress and advise on test readiness
  • Provide structured feedback and debriefs
  • Act professionally, courteously, and lawfully
  • Protect your personal data in line with UK GDPR

Joe reserves the right to end a lesson early on safety grounds.

14. Statutory Rights

Nothing in these Terms and Conditions affects your statutory rights under UK consumer law.

With your permission, successful test results may be shared on social media.

Your Rights

You have rights of access, correction, erasure, restriction, objection, and data portability.

We will respond within one month.

Complaints

If you are unhappy with data handling, contact Joe first.
